1. Acceptance of Terms

By accessing or using the 808 Elite platform ("Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. These Terms apply to all visitors, subscribers, moderators, and administrators.

2. Platform Description

808 Elite is the exclusive community platform for the 808 Collective Pulse Elite membership. The Platform provides access to live stream notifications, community features, moderator profiles, live schedules, highlight content, and community engagement tools. Access to certain features requires an active Pulse Elite membership invitation.

3. Membership and Access

• Subscriber Access: Subscriber accounts are created by invitation only. Invitations are issued by platform moderators. You may not share, transfer, or sell your access credentials.
• Moderator Access: Moderator accounts are granted exclusively by the platform administrator. Moderators are responsible for all actions taken under their account.
• Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

4. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws
• Harass, intimidate, or harm other community members
• Post or share content that is defamatory, obscene, or violates third-party rights
• Attempt to gain unauthorized access to any part of the Platform
• Scrape, copy, or redistribute Platform content without written permission
• Impersonate any moderator, administrator, or other user
• Interfere with or disrupt the Platform's infrastructure or security

5. User Content

By submitting content to the Platform (including profile information, shoutouts, or other community contributions), you grant 808 Collective a non-exclusive, royalty-free license to display and use that content within the Platform. You represent that you have the right to submit such content and that it does not infringe any third-party rights.

6. Third-Party Services

The Platform includes links and integrations with TikTok and other third-party services. Your use of those services is governed by their respective terms and conditions. We are not responsible for the content, availability, or practices of third-party services.

7. Intellectual Property

All Platform content, branding, logos, and design elements are the property of 808 Collective or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without express written permission.

8. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the Platform is at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, 808 Collective and its moderators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, even if advised of the possibility of such damages.

10. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to the community, other users, or the Platform's integrity.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the Platform shall be resolved through good-faith negotiation or, if necessary, binding arbitration.
